Blackwell Photography Policies
Client understands that Blackwell Photography owns the copyright to all images. The images may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in advertising. The Media may not be resold, relicensed, or sub-licensed. Title and ownership, and all rights now and in the future, of and for the images remain exclusively with Blackwell Photography. There are no warranties, express or implied. The images are provided ‘as is’. Blackwell Photography will not be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer’s use of the Media. Blackwell Photography reserves the right to refuse, increase rates or grant such authorization on a case by case basis.
Client agrees to indemnify, defend and hold individuals, Marc & Stacey Blackwell & Blackwell Photography harmless for any and all liabilities, damages, claims, suits, judgments, costs, fees and expenses that arise as a result of or in connection with the services provided.
Blackwell Photography is an independent contractor. As an independent contractor, Photographer will perform the services set forth under the general direction of Client, but the Photographer will determine, in his sole discretion, the manner and means by which the services are accomplished. Photographer agrees to furnish all tools and materials necessary to accomplish the services.
Consultation and Scheduling
For regular photography sessions we are available for a brief consultation over the phone. If your project is larger we will arrange a time to meet in person to discuss the project in more detail.
Upon scheduling your shoot you will be asked to pay a retainer of at least 50% of the total cost. We accept cash, check or major credit cards via PayPal. A 4% processing fee will be added for PayPal transactions.
All clients must sign an agreement before shooting.
A non-refundable retainer of at least 50% the total amount due is required to book your photoshoot.
Cancellations and Rescheduling
Our time is valuable, and so is yours. We plan our days and weeks around photoshoots. Please be considerate and if you need to cancel or reschedule do so via phone or e-mail within 48 hours of your shoot. Rescheduled shoots will have the retainer transferred. Cancellations will be subject to forfeiture of the retainer.
Failure to arrive for a scheduled shoot without any type of notification will be subject to forfeiture of the retainer. Subsequently, all future shoots booked must be paid in full, in advanced.
Full payment is required on the day of the photoshoot, unless special arrangements have been made in advance. We accept cash, check (payable to Blackwell Photography) or any major credit card.
Due to the nature of photography services all sales are final and no exchange/refunds will be offered.
Arrivals and Late Arrivals
Please arrive on time for your shoot. If you are using a make up artist you will have time to complete your hair and make up. Otherwise, please come camera ready. In consideration to our other clients and Blackwell Photography a late arrive will result in a shortened session, with full session fees.
